Thanks for choosing Vizzy (“we”, “us”, “our”). The following Terms of Service apply when you use the Vizzy service, websites, or software applications (together, the “Vizzy Service” or “Service”). Please review the following terms carefully. By accessing or using the Service, you signify your agreement to these Terms of Service. If you do not agree to these Terms of Service, you may not access or use the Service.
These terms and conditions govern all use of the Vizzy website and all content, services, and products available at or through the website, including Vizzy Free and all Vizzy paid subscription accounts. The website is offered subject to your acceptance without modification of all of the terms and conditions contained herein, along with all other operating rules, policies (including our Privacy Policy), and procedures that may be published from time to time.
In order to use the Vizzy Service, you must (a) be 18 or older, or be 13 or older and have your parent or guardian's consent to these Terms, and (b) have the power to enter a binding contract with us and not be barred from doing so under any applicable laws.
Occasionally we may, in our discretion, make changes to the Vizzy Service and these Agreements. When we make changes that we consider material, we will notify you through the Service. Your continued use of or access to the website following the posting of any changes to this Agreement constitutes acceptance of those changes. Vizzy may also, in the future, offer new services and/or features through the website, which shall be subject to the terms and conditions of this Agreement.
Vizzy allows you to upload, store, and display content on your screens, including images, videos, documents, and other media (“User Content”). You represent that you have the right to use any User Content you make available through the Service, and that such User Content does not violate these Agreements, applicable law, or the intellectual property rights of any third party.
By making User Content available, you represent and warrant that:
By submitting User Content to Vizzy, you grant Vizzy a worldwide, royalty-free, non-exclusive licence to store, reproduce, and display the content solely for the purpose of operating and delivering the Service to you. If you delete content, Vizzy will use reasonable efforts to remove it from the Service, though you acknowledge that cached copies may not be immediately removed.
Vizzy does not routinely monitor User Content but reserves the right to remove or disable access to any User Content at its sole discretion, without prior notice. If you believe that any content on the Service infringes your intellectual property rights, please contact us at support@getvizzy.co.
Vizzy will make reasonable efforts to keep the Service operational. However, certain technical difficulties or maintenance may, from time to time, result in temporary interruptions. Vizzy reserves the right, periodically and at any time, to modify or discontinue, temporarily or permanently, functions and features of the Service, with or without notice, all without liability to you for any interruption, modification, or discontinuation. You understand and agree that Vizzy has no obligation to maintain, support, upgrade, or update the Service, or to provide all or any specific content through the Service.
Prices for all Services, including monthly subscription fees, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Vizzy website or by notifying you through the Service. Vizzy shall not be liable to you or to any third party for any price change, suspension, or discontinuance of the Service.
By selecting a paid subscription, you agree to pay Vizzy the monthly subscription fees indicated for that plan. Subscriptions are billed monthly in advance. Upon the end of each billing period, if you have not cancelled, you will automatically be billed for the following period.
Payment is made by credit card through our payment processor. When you add or remove screens from your subscription, the quantity change takes effect immediately and will be reflected in your next billing cycle.
Unless you cancel your paid subscription before the end of the applicable billing period, your subscription will automatically renew and you authorize us to collect the applicable monthly fee using the payment method we have on record for you.
Paid subscriptions can be cancelled at any time from Settings → Billing. The cancellation takes effect at the end of your current billing period — you retain full access until then.
There are no refunds or credits for partial months of service, unused subscription periods, or any other reason. In order to treat everyone equally, no exceptions will be made.
Vizzy respects the intellectual property rights of others. If you believe that material on the Service violates your copyright, please notify us at support@getvizzy.co. Vizzy will respond to all such notices, including by removing infringing material or disabling links to it as required. Vizzy may terminate a user's access to the Service if that user is determined to be a repeat infringer of intellectual property rights.
This Agreement does not transfer from Vizzy to you any Vizzy or third-party intellectual property. All right, title, and interest in and to such property will remain solely with Vizzy. Trademarks, service marks, graphics, and logos used in connection with the website may be the trademarks of other third parties. Your use of the Service grants you no right or licence to reproduce or otherwise use any Vizzy or third-party trademarks.
Vizzy may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate your Vizzy account, you may do so from Settings. All provisions of this Agreement which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
In no event will Vizzy, or its suppliers or licensors, be liable with respect to any subject matter of this Agreement under any contract, negligence, strict liability, or other legal or equitable theory for: (i) any special, incidental, or consequential damages; (ii) the cost of procurement of substitute products or services; (iii) interruption of use or loss or corruption of data; or (iv) any amounts that exceed the fees paid by you to Vizzy under this Agreement during the twelve (12) month period prior to the cause of action. Vizzy shall have no liability for any failure or delay due to matters beyond its reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
The Service is provided “as is.” Vizzy and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither Vizzy nor its suppliers and licensors make any warranty that the Service will be error-free or that access will be continuous or uninterrupted. You understand that you obtain content or services through the Service at your own discretion and risk.
You agree to indemnify and hold harmless Vizzy, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the Service, including but not limited to your violation of this Agreement.
Should any provision of these Terms be held invalid or unenforceable for any reason or to any extent, such invalidity or unenforceability shall not affect or render invalid or unenforceable the remaining provisions of the Terms, and the application of that provision shall be enforced to the extent permitted by law.
These Agreements are subject to the laws of Canada, without regard to choice or conflicts of law principles. You and Vizzy agree to the exclusive jurisdiction of the courts of Canada to resolve any dispute, claim, or controversy arising in connection with these Agreements.

This Agreement constitutes the entire agreement between Vizzy and you concerning the subject matter hereof, and may only be modified by a written amendment signed by an authorized representative of Vizzy, or by Vizzy posting a revised version.
